A Fallacy

I'm very glad that I am getting a classical education along with my children.  That led me to recognize when my son was trying to use some faulty logic on me this morning.  Here it was:

The fruit is in the dining room and can be eaten at any time.
The cake balls are also in the dining room.
Therefore, the cake balls must be fruit and can be eaten at any time.
